Following completion of the website and final acceptance by the customer,Developer shall be permitted to list the customer and the customer's website on Developers website and in any of its marketing and advertising as having been developed by the Developer.The material included on Developer's website shall include a hypertext link to the customer's website.Customer shall have full discretion as to the form and content of such acknowledgment and the appearance of any link.

6. Services

All services provided by Smart Soft Experts Ltd may only be used for lawful purposes. The laws of the Republic of Kenya apply. Use of our hosting servers or any of our services to infringe upon any copyright or trademark is prohibited. Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice. Any domain or website found to host sexually explicit material, nudity or pornography or linking to pornography will be suspended immediately without notice. All websites developed by Smart Soft Experts Ltd must retain a link crediting development back to us. We reserve the right to refuse service to anyone.

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. Any user who sends out spam will have their account terminated with or without notice.

8. Payment information

You agree to supply appropriate payment for the services received in advance of the time period during which such services are provided. You agree that until and unless you notify us of your desire to cancel any or all services received, those services will be billed on a recurring basis. Smart Soft Experts reserves the right to change the yearly or monthly payment amount and any other charges at anytime. The amount you pay for your hosting will never increase from the date of purchase until the contract period is up.

9. Technical support

Smart Soft Experts will provide a guaranteed service availability of 99.9%. Technical support will be provided via the following ways:
• Telephone support.
• On-site support visits.
We strive to provide an initial response time of 1hr for all tickets logged within official working hours ie 8am to 5pm, Monday to Friday excluding weekends and public holidays. The network will be monitored 24 hrs a day, 365 days a year. Emergency technical support outside of working hours will be responded to as soon as possible. Site visit support will be billed.
